A Colorado woman has been sentenced to jail after she was convicted of having sex with a 13-year-old boy and then carrying his child to term.
Andrea Serrano of Fountain admitted to engaging in a sexual relationship with an underaged boy and it resulted in her becoming pregnant and eventually having the baby.
Despite a plea deal from her lawyers that would effectively allow her to “plead with her belly” in order to avoid prison, she is set to serve 90 days in jail, minus seven days previously served.
According to KKTV, Serrano will also have to be on the sex offender list for anywhere from 10 years to life and will need to be on supervised probation.
Fountain Police began their investigation in 2022, after being tipped off by somebody familiar with the illicit relationship.
Prior to the plea deal being accepted, the mother of the boy expressed her discontent to the Judge.
“She (Serrano) sexually assaulted my 13-year-old son … She introduced him to drugs, she needs to be in jail,” the mother of the victim said in court. “It’s a double standard. If she was a man, and my son was a girl she (Serrano) would be behind bars right now.”
The mother of the underaged victim is unhappy with the sentencing, feeling that if gender roles were reversed, Serrano would have faced much steeper penalties.
The plea deal had potential sentencing of 10 years to life on sex-offender intensive supervision probation, as well as having to register as a sex offender for the remainder of her life so the mother of the boy felt 90 days was a slap on the wrist.
“I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her,” the victim’s mother said.
The mother went on to say that the sentencing sets a bad example for the community.
Serrano will start serving her time next week, having previously been granted a week-long stay to ensure that her children were well cared for.
